Lemon Law Attorneys in Tulsa, Oklahoma
You bought a new vehicle expecting reliability. Instead you've made trip after trip to the dealership — and the problem still isn't fixed. If that sounds familiar, you may have a lemon. Oklahoma and New Mexico both have lemon laws that require manufacturers to either replace your vehicle or refund your purchase price when they can't repair a defect within a reasonable number of attempts. The problem is that manufacturers rarely do this voluntarily. They count on consumers not knowing their rights — or not having an attorney willing to take them to court.
What most consumers don't know is that a lemon law claim also typically supports a federal warranty claim under the Magnuson-Moss Warranty Act — which can significantly expand the damages you are entitled to recover. We will discuss both claims and pursue every available remedy on your behalf.
Do You Have a Lemon?
You may have a lemon law claim if:
You purchased a new vehicle in Oklahoma or New Mexico
The vehicle has a defect covered by the manufacturer's warranty
You have returned the vehicle for repairs multiple times and the defect persists
The defect substantially impairs the use, value, or safety of the vehicle
The manufacturer or dealer has failed to repair the defect within a reasonable number of attempts
Oklahoma does not have a lemon law for used vehicles. If you purchased a used vehicle with problems, visit our Car Dealer Fraud page — you may still have significant legal rights.
What You Are Entitled To Under State Lemon Law:
Under Oklahoma's lemon law, if your vehicle qualifies, the manufacturer must either:
Accept return of the vehicle and refund the full purchase price — including taxes, license, registration fees, and similar governmental fees, less a reasonable allowance for use; or
Replace the vehicle with a comparable new model acceptable to you
Manufacturers routinely resist these demands, betting that consumers will give up or can't find an attorney willing to sue an automaker. We sue automobile manufacturers — and we win.
The Magnuson-Moss Warranty Act — Additional Federal Remedies:
Most lemon law claims also give rise to a federal claim under the Magnuson-Moss Warranty Act — and that federal claim can significantly increase what you recover.
The Magnuson-Moss Warranty Act is a federal law that governs written warranties on consumer products, including vehicles. When a manufacturer fails to honor its written warranty — as is the case when your vehicle has repeated unrepaired defects — you may have a claim under Magnuson-Moss in addition to your state lemon law claim.
Why does this matter? Because Magnuson-Moss provides remedies that go beyond what state lemon law alone allows:
Actual damages — the full measure of your economic loss, which may exceed the vehicle's purchase price depending on your circumstances
Consequential damages — costs you incurred as a result of the manufacturer's failure to honor the warranty, such as rental car expenses, repair costs, and other out-of-pocket losses
Attorney's fees — the manufacturer can be required to pay your attorney's fees if you prevail, which is not always available under state lemon law alone
In practical terms, a Magnuson-Moss claim layered on top of a state lemon law claim means manufacturers face significantly greater exposure — which typically produces better outcomes for consumers, whether through a more favorable settlement or a larger recovery at trial.
Not every lemon law case will support a Magnuson-Moss claim, and the interaction between federal and state remedies requires careful analysis. We evaluate both claims from the outset and pursue every available remedy to maximize your recovery.
Why You Need an Attorney:
Lemon law and Magnuson-Moss cases require careful documentation, thorough knowledge of both state and federal law, and willingness to take a major manufacturer to court. Luke Wallace has been admitted pro hac vice in courts nationwide and has the trial experience to see these cases through.
